Terms and Conditions

1. Agreement to Terms

By accessing or using Encory ("Service," "Application," or "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Encory is a private web application that allows users to:

• Track and record intimate encounters
• Manage partner information
• Create optional public profiles
• Store encrypted personal data

The Service uses end-to-end encryption to protect your sensitive data.

3. Eligibility

3.1 Age Requirement

You must be at least 18 years old to use this Service. By using Encory, you represent and warrant that you are 18 years of age or older.

3.2 Legal Capacity

You must have the legal capacity to enter into a binding agreement in your jurisdiction.

3.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. User Accounts

4.1 Registration

To use the Service, you must create an account with:

• A valid email address
• A secure password
• A PIN code for encryption

4.2 PIN Code and Encryption

• Your PIN code is used to encrypt your sensitive data
• We cannot recover your data if you forget your PIN
• You are solely responsible for remembering your PIN
• Optional: You may store your encryption key on our servers for convenience

4.3 Account Security

You agree to:

• Use a strong, unique password
• Not share your account credentials
• Enable appropriate security measures
• Log out from shared devices

5. Membership Tiers and Subscriptions

5.1 Available Plans

5.2 Subscription Pricing

All prices include applicable taxes.

5.3 Payment Processing

• Payments are processed by our third-party payment provider Creem.io (Creem Technologies Ltd.)
• By making a purchase, you also agree to Creem.io's Terms of Service and Privacy Policy
• We do not store your payment card details; all payment information is handled securely by Creem.io
• Available payment methods depend on your region and are provided by Creem.io

5.4 Subscription Terms

• Automatic Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless canceled
• Billing Date: You will be charged on the same date each billing cycle
• Price Changes: We will notify you of any price changes at least 30 days before they take effect
• Failed Payments: If a payment fails, we may retry the charge. Continued failure may result in subscription suspension

5.5 Cancellation

• You may cancel your subscription at any time from the Membership page
• Cancellation takes effect at the end of the current billing period - you retain access to paid features until then
• No partial refunds are provided for unused time within a billing period
• After cancellation, your account reverts to the Free tier

5.6 Promotional Codes

• Memberships may also be activated via promotional codes
• Promo code memberships have a fixed duration and do not auto-renew
• Promo codes cannot be combined with active subscriptions

5.7 Membership Expiration

When your paid membership expires:

• Photos exceeding the Free limit will be hidden (not deleted)
• Public profile features will be disabled
• Expiring profile links will be deactivated
• Upon renewal or resubscription, hidden content will be restored

5.8 Refunds

• Due to the digital nature of the Service, all purchases are final
• Refunds are only available where required by applicable law (e.g., EU consumer protection laws)
• Refund requests must be submitted within 14 days of purchase to legal@encory.app
• Approved refunds will be processed through Creem.io to your original payment method

5.9 Free Trial

• We may offer free trial periods at our discretion
• At the end of a trial, you will be charged unless you cancel before the trial ends
• Free trials are limited to one per user

6. Acceptable Use

6.1 You Agree To:

• Use the Service only for lawful purposes
• Provide accurate information
• Respect the privacy of others
• Not attempt to circumvent security measures
• Not reverse engineer the Application

6.2 You Agree NOT To:

• Upload illegal content (including but not limited to child sexual abuse material)
• Store data about non-consenting individuals
• Impersonate others
• Use the Service for commercial purposes without authorization
• Distribute malware or engage in hacking
• Violate any applicable laws or regulations
• Abuse, harass, or harm others
• Circumvent membership restrictions

6.3 Content Standards

All content you upload must:

• Feature only consenting adults (18+)
• Not violate any third-party rights
• Not be defamatory, obscene, or illegal
• Not promote illegal activities

7. User Content

7.1 Ownership

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to store and process it as necessary to provide the Service.

7.2 Encrypted Content

Due to end-to-end encryption:

• We cannot access, view, or moderate your encrypted content
• You are solely responsible for the content you store
• We rely on your compliance with these Terms

7.3 Public Profile Content

If you create a public profile:

• Your profile may be viewed by anyone with the link
• You are responsible for what you share publicly
• You must have rights to all photos you upload

7.4 Content Removal

We reserve the right to remove content or disable accounts that violate these Terms, to the extent technically possible.

7.5 Public Profile Visit Analytics

If you create a public profile, the following terms apply to visit analytics (Premium feature):

Data Collection:

• When visitors access your public profile, we collect anonymous visit data
• Data includes: geolocation (country, region, city), device type, browser family, and visit timestamp
• Raw IP addresses are never stored; we use a hashed identifier that changes daily

Your Responsibilities:

• You understand that making your profile public enables visit tracking
• Analytics are provided for informational purposes only
• You may not use analytics data to attempt to identify individual visitors
• You may not misrepresent your analytics data

Visitor Privacy:

• Visitors are not tracked across profiles or sessions
• No cookies are used for analytics tracking
• Visitor identity remains anonymous; individual visitors cannot be identified
• Your own visits to your profile are flagged separately and excluded from statistics

Limitations:

• Analytics accuracy depends on visitor browser settings and network conditions
• We do not guarantee completeness or accuracy of analytics data
• Rate limiting (1 visit/minute per visitor) may affect recorded statistics

8. Intellectual Property

8.1 Our Rights

The Service, including its design, features, code, and content (excluding user content), is owned by Encory and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8.3 Restrictions

You may not:

• Copy, modify, or distribute our software
• Use our trademarks without permission
• Remove any proprietary notices

9. Third-Party Services

9.1 Payment Processing

We use Creem.io (Creem Technologies Ltd.) to process payments. When you make a purchase:

• Your payment is processed according to Creem.io's terms and privacy policy
• Creem.io may collect and process your payment information
• We are not responsible for Creem.io's handling of your payment data

9.2 Other Third Parties

The Service may integrate with other third-party services (e.g., authentication providers). Your use of such services is subject to their respective terms and policies.

9.3 Third-Party Links

The Service may contain links to external websites. We are not responsible for the content or practices of these websites.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Disclaimers

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Your data will never be lost

11.3 Encryption Disclaimer

While we use strong encryption:

• No security measure is 100% effective
• You accept the inherent risks of storing sensitive data online
• If you lose your PIN, your data is permanently inaccessible

12. Limitation of Liability

12.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENCORY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or goodwill
• Damages exceeding the amount you paid us in the past 12 months

12.2 Exceptions

Some jurisdictions do not allow liability limitations. In such cases, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Encory, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload

14. Termination

14.1 By You

You may delete your account at any time through the Settings page. Upon deletion:

• All your data will be permanently removed within 30 days
• Active subscriptions will be canceled (no refund for remaining time)
• Encrypted data becomes permanently inaccessible
• This action is irreversible

14.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in illegal activity
• Abuse the Service
• Fail to pay for services (if applicable)

14.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases
• Active subscriptions are canceled without refund
• Provisions that should survive (liability, indemnification) remain in effect

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at legal@encory.app to attempt informal resolution.

15.3 Arbitration

Any disputes not resolved informally will be resolved through binding arbitration in accordance with the Czech Arbitration Court rules, except where prohibited by law.

15.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via:

• Email notification
• In-app notification
• Notice on the website

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Encory.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 Waiver

Our failure to enforce any right does not waive that right.

17.4 Assignment

We may assign our rights under these Terms. You may not assign yours without our consent.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control.
